Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Trevurs mobile application and website at www.trevurs.com (collectively, the "Service"), operated by Trevurs ("we", "our", or "us"). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service you represent and warrant that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. License to Use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes. You may not sublicense, sell, resell, transfer, or otherwise exploit any portion of the Service.

4. User-Generated Content

The Service allows you to create, upload, and publish tours, audio recordings, images, comments, and other content ("User Content"). By submitting User Content you:

• Represent that you own or have the necessary rights to share such content.
• Grant Trevurs a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, distribute, and display your User Content solely to operate and improve the Service.
• Acknowledge that your published tours, username, and comments are visible to all users of the Service.

We reserve the right (but not the obligation) to review, moderate, or remove any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

5. Prohibited Conduct

You agree not to:

• Post content that is unlawful, defamatory, obscene, hateful, or otherwise objectionable.
• Infringe the intellectual property, privacy, or other rights of any third party.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Use the Service for any commercial purpose without our prior written consent.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Scrape, crawl, or otherwise extract data from the Service by automated means.
• Introduce malware, viruses, or other harmful code.
• Violate any applicable local, national, or international law or regulation.

6. Premium Plans & Subscriptions

Trevurs offers the following paid plans ("Premium Plans"):

Prices shown are in US Dollars and may vary by country or region based on local pricing set in the App Store or Google Play. The final price in your local currency is shown at the time of purchase.

6.1 Billing

Payment for auto-renewable subscriptions is charged to your Apple ID account (iOS) or Google Play account (Android) at confirmation of purchase. Subscriptions automatically renew at the same price and duration unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

6.2 Managing and Cancelling Subscriptions

You can manage your subscription and turn off auto-renewal at any time by going to your Account Settings in the App Store or Google Play after purchase:

• iOS: Open the Settings app → tap your Apple ID → Subscriptions → Trevurs.
• Android: Open the Google Play app → tap your profile icon → Payments & subscriptions → Subscriptions → Trevurs.

Cancelling auto-renewal does not immediately end your current subscription period; you retain Premium access until the end of the period you paid for. No refunds are issued for the remaining portion of a subscription period upon cancellation, except as required by applicable law.

6.3 Restoring Purchases

If you reinstall the app or switch devices, you can restore your purchases using the "Restore Purchases" option in the app's subscription screen. Purchases are tied to your App Store or Google Play account.

6.4 Free Trials

If a free trial is offered for a subscription plan, it will be clearly disclosed before purchase. Any unused portion of a free trial period will be forfeited when you purchase a subscription. Only one free trial is available per subscription product per Apple ID or Google account.

6.5 Lifetime Purchase

The "Premium Forever" plan is a one-time, non-consumable purchase. It is not a subscription and does not auto-renew. It grants permanent Premium access on all devices associated with your App Store or Google Play account, subject to the continued availability of the Service.

6.6 Premium Features

Premium Plans unlock benefits including but not limited to: unlimited tour downloads, an ad-free experience, and priority access to new features. The specific benefits may change over time; we will notify active Premium subscribers of any material reductions in benefits.

7. Intellectual Property

All content, design, code, trademarks, and other materials forming part of the Service (excluding User Content) are the property of Trevurs or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any rights in such materials other than the limited license in Section 3.

8. Third-Party Services

The Service integrates third-party services including Apple App Store, Google Play, RevenueCat (subscription management), Google Maps, and Google AdMob (advertising for free-plan users). Your use of those services is governed by their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Geographic and navigational information (maps, routes, points of interest) in the Service is provided for informational purposes only. Always exercise your own judgment when following any route or visiting any location.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TREVURS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY THIRD-PARTY CONDUCT OR CONTENT; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR CONTENT.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TREVURS IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $10.

11. Indemnification

You agree to indemnify, defend, and hold harmless Trevurs and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. You may delete your account at any time via the in-app account deletion option or by contacting us. Upon termination, the license granted in Section 3 ends immediately. Sections 7, 9, 10, 11, and 13 survive termination.

13. Governing Law & Disputes

These Terms are governed by the laws of Argentina, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved exclusively by the courts of Argentina, and you consent to personal jurisdiction in those courts.

Notwithstanding the foregoing, nothing in these Terms limits your rights under any applicable mandatory consumer protection laws in your country of residence.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by in-app notice or email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, stop using the Service and cancel any active subscriptions.
